GENERAL TERMS AND CONDITIONS OF CONTRACT

GENERALITIES

The present general terms and conditions of sale apply to all purchases of products on www.manimatte.ch, the online shop of the website of Azienda agricola Manimatte sagl (hereinafter referred to as the “site”). The term “customer” used in the following text refers naturally to both men and women. The offers of products and services published online are valid as long as they are visible on the site and until stocks last. The illustrations present on the site are provided for indicative purposes only and are not binding. The information provided on the detail pages of each individual product and the explanations should be considered as indicative and are not binding. Azienda agricola Manimatte sagl disclaims any responsibility for any errors or inaccuracies related to drawings, images, or diagrams present on the aforementioned pages.

PRICES

I prezzi indicati sul sito sono esclusivamente espressi in franchi svizzeri. Essi sono comprensivi di IVA e tassa di riciclaggio anticipata (TRA) e non includono eventuali spese di imballo e spedizione che saranno fatturate separatamente. Tutti gli ordini sono pagabili esclusivamente in franchi svizzeri. Azienda agricola Manimatte sagl si riserva il diritto di modificare i suoi prezzi in qualsiasi momento. I prezzi fatturati al cliente per i prodotti ordinati rimangono quelli che erano in vigore nel giorno in cui è stato effettuato l’ordine e che figurano sulla conferma dell’ordine. Gli sconti promozionali offerti sul sito nell’ambito di offerte commerciali specifiche non sono cumulabili con altri sconti, salvo diverse disposizioni. Questi sconti promozionali sono direttamente dedotti dall’importo dell’ordine d’acquisto. Le promozioni sono fino ad esaurimento della stessa o esaurimento dell'articolo

ORDER CONFIRMATION

The submission of the order by the customer implies the full and unlimited acceptance of these General Terms and Conditions to the exclusion of any other terms or conditions. The order is considered fulfilled upon receipt of the confirmation email and becomes effective only after acceptance by Azienda agricola Manimatte sagl. Azienda agricola Manimatte sagl reserves the right to refuse orders from a customer. To modify or cancel an order, the customer is required to send an email to info@manimatte.ch indicating the order number.

SHIPPING

The order is dispatched via courier or our means within 72 working hours following its correct receipt. Azienda agricola Manimatte sagl disclaims any responsibility for delays due to external factors. Shipping costs for Switzerland and Liechtenstein are applied according to this scheme: from 1 to 12 bottles CHF 12, from the 13th bottle CHF 24, from the 25th bottle CHF 36, and so on.

CONTRACT STIPULATION

The products and prices published in the online shop are valid as an offer. However, this offer is always subject to the conditions (of dissolution) related to the impossibility of making a delivery or to an incorrect price indication (by the manufacturer or Azienda agricola Manimatte sagl). The contract is to be considered concluded as soon as the customer sends their order to Azienda agricola Manimatte sagl. The receipt of the order is communicated to the customer via an automatically generated order confirmation sent to the email address they provided. The receipt of the automatically generated order confirmation does not imply any confirmation that the product is actually available or that it can be delivered. The order confirmation simply informs the customer that the order has been received by Azienda agricola Manimatte sagl and that therefore the contract is in effect, while remaining subject to the condition of the possibility of delivery. Orders can only be placed by individuals or companies residing in Switzerland, and delivery is made solely within Switzerland.

PAYMENT

The invoiced price is the price indicated on the order confirmation that is sent to the customer. Unless otherwise stipulated, all products and services are payable upon online order confirmation via the following payment methods: Credit Card (Mastercard, Visa, Diners, American Express), Post-Finance Card, Post-Finance E-Finance, TWINT

SUBSTITUTION, RETURN, WARRANTY SERVICES, COMPLAINTS AND DEFECT NOTIFICATIONS

Any complaints related to defective goods and/or incomplete services, as well as returns, must be exclusively submitted by the customer directly to Azienda agricola Manimatte sagl and dealt with there. The existence of such disputes does not release the customer from the obligation to pay the invoice or the full value of the item in dispute. It is the customer's responsibility to check the goods at the time of delivery. In general, all returned items that are incomplete, damaged, or dirty will not be accepted. Shipping costs in the case of a return of the goods are to be borne by the customer. Hidden defects must be reported in writing immediately after being detected. Unless otherwise communicated, defective goods must be kept until their return and may not be consumed.

EVENTS

In the case of organised events, advance payment of the registration fee is required to complete the registration. Ticket refunds are subject to the following rules:

  • up to 5 days before the start of the event, the total cost of the ticket is refunded
  • from 5 to 48 hours before the event, half of the ticket is refunded
  • 48 hours before the event, the ticket is non-refundable

COMPLAINTS ABOUT QUALITY

Manimatte sagl agricultural company stores its wine bottles in compliance with the current laws in Switzerland regarding the preservation of food and beverages. According to the guidelines of the Swiss Wine Trade Association, defective bottles will only be replaced in the case of wine of any origin but bottled in Switzerland, and in any case within one year of purchase. Foreign wines bottled abroad will neither be replaced nor refunded. Notification of any defects or faults must occur within 8 days of collection or receipt of the goods.

AGE LIMITS

By confirming the order with Azienda agricola Manimatte sagl, the customer declares that they are of legal age and have the necessary age to purchase and consume alcohol in the country where the order is placed. If Azienda agricola Manimatte sagl discovers that the customer does not meet the legal requirements to purchase alcohol, Azienda agricola Manimatte sagl reserves the right to cancel the order immediately and without notice.

RESOLUTION CLAUSE

The total or partial non-fulfilment by the customer of any of their obligations and the failure to meet a payment deadline will put Azienda agricola Manimatte sagl in the position to: demand payment of the amount due, suspend all deliveries, terminate the ongoing contract.

APPLICABLE LAW, DISPUTES

This contract is governed by Swiss law. Any disputes arising from or related to the sales contracts shall be subject to the exclusive jurisdiction of the courts of Lugano.
